Location of Proposed Project: On Whitman Road where the Kinderhook Creek crosses through an existing steel culvert, approximately 550 feet southeast of the intersection of Whitman Road and Hancock Road (Route 43). Project Description: <strong>This project involves the removal of the existing 75\u2019 long, 36\u201d-48\u201d diameter steel culvert, and the installation of a new 4-sided concrete box culvert.<\/strong> The new box culvert will span 16\u2019 across the Kinderhook Creek and will meet all Massachusetts Stream Crossing Standards. The new concrete culvert is proposed to be located approximately 30\u2019 further northwest than the existing steel culvert to provide a better flow direction and a shorter culvert length. As a result, minor stream relocation will occur on the downstream side as well as minor grading within the pond on the upstream side to create an appropriate stream connection. A portion of the existing paved road will need to be raised in elevation to accommodate for the new culvert structure, which will require pavement milling and repaving. A wetland replication area is provided to accommodate for impacts to an existing bordering vegetated wetland area as a result of the minor stream relocation. An Ecological Restoration Notice of Intent (WPA Form 3A) will be submitted to the Town of Hancock Conservation Commission and the Massachusetts Department of Environmental Protection (MassDEP) in mid-June 2025. Once filed, copies of the NOI application will be available for review at the Hancock Town Hall, located at 3650 Hancock Rd Hancock, MA 01237. Both dams are owned and operated by the City of North Adams and function as critical infrastructure for the City of North Adams Public Water Supply. Fred Puddester is proposing to implement a <strong>restoration management program at Puddester\u2019s Pond to manage nuisance plant growth and invasive species. Management actions may include herbicide applications, hand pulling, hydroraking, native replanting, and placement of benthic barriers. Management actions may also include the installation and use of an aeration system to help improve water quality conditions in the pond and the placement of sand around a portion of the pond perimeter to create turtle nesting habitat<\/strong>. Brookfield Renewables Bear Swamp Project will only use herbicides recommended by MDAR for use in regulated sensitive areas for their IVM program. Pursuant to 333 CMR 11.04, no herbicides will be sprayed within any designated &#8220;no spray sensitive area&#8221; instead mechanical only methods will be used to control vegetation. Foliar herbicide applications will selectively treat target vegetation and encourage the growth of non-target vegetation. One selective post-emergent herbicide application will take place in ballasted rights-of-way areas and around other fixtures including but not limited to: switches, signals, signs, and highway grade crossings. This post-emergent application will take place in non-sensitive areas and sensitive area buffer zones and is targeted toward the eradication of woody and herbaceous plant species. Areas that do not have vegetation will not be treated. Herbicide applications to the roadbed and areas adjacent to the shoulder will be conducted with a spray truck and\/or a backpack sprayer according to the guidelines set forth in the VMP and YOP. Sensitive areas as defined by the Rights-of-Way Management Regulations will receive the full protection afforded by those regulations. All herbicide applications will be done by an applicator properly licensed by MDAR Pesticide Bureau and fully trained in herbicide mixing, handling, and application methods. Applications will commence following approval of the YOP by MDAR. Herbicides shall be applied to the roadbed by a spray truck, in accordance with the guidelines set forth in the VMP and the YOP. The herbicides to be applied, Aquaneat, Opensight, Polaris, and MSO Extra are recommended for use in &#8220;sensitive areas&#8221; by the Department of Environmental Protection, and MDAR. No herbicides shall be applied within a Zone I of a public groundwater source, within 100\u2019 of any Class A public surface water source, within 100\u2019 of any tributary or associated surface water body where the tributary or associated surface water body runs within 400\u2019 of a Class A surface water source, or within 10\u2019 of any tributary or associated surface water body where the tributary or associated surface water body is at a distance greater than 400\u2019 from a Class A surface water source, within a lateral distance of 100\u2019 for 400\u2019 upstream, on both sides of the river, of any Class B Drinking Water Intake, a 50-foot radius around a private well, 10\u2019 from the edge of standing or flowing water or wetlands, within 10\u2019 of the mean annual high water line or any River, or within 10\u2019 of any certified vernal pool (pursuant to 333 CMR 11.04: Sensitive Area Restrictions). Applications of herbicide shall commence after the approval of the YOP by MDAR, following public review and comment. It is anticipated that herbicide application will occur between May \u2013 end of August 2025. The YOP contains: maps locating rights-of-way and sensitive areas; the name of the herbicides proposed for use, including application rates, carriers and adjuvants; application techniques and alternative control measures; material safety data sheets and herbicide fact sheets as approved by the DAR; the names of the applicator and YOP supervisor; methods used to identify and mark sensitive areas on the right-of-way; procedures for handling, mixing, and loading of herbicides; and identification of target vegetation in accordance with 333 CMR 11.06(2). Additionally, the YOP contains emergency\/contingency measures and local, state and federal emergency contact telephone numbers. &#8211; comments due 5\/9\/2025<\/li>\n<li><strong>Great Barrington &#8211; <a class=\"table-link\" href=\"#berkshire\">Berkshire Natural Resources Property Exploration Wells &#8211; <\/a>\u00a0<\/strong>Secretary&#8217;s Certificate on FEIR &#8211; published 3\/26\/2025<\/li>\n<li><strong>Pittsfield &#8211; <\/strong><a href=\"https:\/\/eeaonline.eea.state.ma.us\/EEA\/MEPA-eMonitor\/submittal\/23facede-2db0-4708-8649-5a71b2891032\" target=\"_blank\" rel=\"noopener\"><strong>Notice of Intent to Initiate an Ecological Restoration Project<\/strong><\/a> &#8211; (click on the link, then at the top, click on attachments) &#8211; Bel Air Dam is part of the Massachusetts Department of Conservation and Recreation (MassDCR) Office of Dam Safety\u2019s (ODS) pilot Abandoned Dams program. As part of this program, MassDCR is seeking to address safety concerns pertaining to dams in the Commonwealth that have no identifiable owner. In the case of Bel Air Dam, neither the City of Pittsfield nor any other interested party has expressed willingness to take ownership of the dam; therefore, the MassDCR ODS is proposing to remove the dam. <strong>The proposed project will remove the Bel Air Dam on the West Branch of the Housatonic River and thereby restore the natural connectivity of a waterway,<\/strong> meeting the definition of an Ecological Restoration Project as defined in 310 CMR 10.04. The proposed project is a Dam Removal Project as listed in 310 CMR 10.13(2), and proposes<strong> removal of the entire dam structure, restoration of a natural stream channel in the area of the current impoundment, establishment of adjacent floodplain, and installation of native herbaceous and woody species.<\/strong> The project area historically contained riparian habitat which has been degraded due to the impoundment. Changes to the environment caused by the presence of the dam include alteration of water temperatures and chemistry, river flow characteristics, and silt loads. <strong>The proposed project will also remove contaminated sediment that has accumulated upstream of the dam which includes elevated levels of chromium, arsenic, lead, polynuclear aromatic hydrocarbons (PAHs), and extractable petroleum hydrocarbons (EPHs).<\/strong> Project activities will occur within jurisdictional areas protected under the Massachusetts Wetlands Protection Act and its implementing regulations, including Land Under Water (LUW), Bordering Vegetated Wetlands (BVWs), Bank, 200-foot Riverfront Area, and Bordering Land Subject to Flooding (BLSF).\u00a0 The Pittsfield Conservation Commission originally issued the Order of Conditions (OOC) for the Bel Air Dam Removal Project on October 23, 2024. MassDCR is submitting a Request to Amend the OOC due to installation of a temporary bridge in the 200-Foot Riverfront Area, which is needed to access the staging area. In addition, the Request to Amend the OOC will include a description of temporary trailer offices in the 200-Foot Riverfront Area. <strong>The hearing is anticipated to be held March 13, 2025, at 70 Allen Street Pittsfield, MA 01201 in City Council Chambers at 6:00 PM<\/strong>. In the case of Bel Air Dam, neither the City of Pittsfield nor any other interested party has expressed willingness to take ownership of the dam; therefore, the MassDCR ODS is proposing to remove the dam. <strong>The proposed project will remove the Bel Air Dam on the West Branch of the Housatonic River and thereby restore the natural connectivity of a waterway,<\/strong> meeting the definition of an Ecological Restoration Project as defined in 310 CMR 10.04. The proposed project is a Dam Removal Project as listed in 310 CMR 10.13(2), and proposes<strong> removal of the entire dam structure, restoration of a natural stream channel in the area of the current impoundment, establishment of adjacent floodplain, and installation of native herbaceous and woody species.<\/strong> The project area historically contained riparian habitat which has been degraded due to the impoundment.
