GREAT BARRINGTON - Benedict Pond Dam Repair
The Massachusetts Department of Conservation and Recreation is proposing maintenance work to the dam face at Benedict Pond. The dam is in a state of disrepair and action is required to ensure the dam functions as designed. The work includes the discharge of dredged or fill material for maintenance repairs to the 550 foot long face ofthe dam along the shore ofthe pond. This work would require about 4,300 square feet of temporary fill consisting of compact gravel for a berm coffer dam that would be constructed in the pond for dewatering the work areas. Approximately 1,500 square feet of pond bottom would be excavated along the face of the dam to expose areas for maintenance work then backfilled with compact gravel. About 1,600 square feet of gravel would be temporarily placed on the pond bottom to support heavy machinery. All temporary fill material would be removed and bottom contours restored following construction activities. The pond water surface would be partially drawn about 4 feet to allow work areas to dewater. Stream flow to Stony Brook would be maintained with a bypass pipe.
Mitigation of temporary impacts to water quality would include a temporary berm coffer dam, and water flow control, bypassing the pond outflow around the work areas during construction. The project will use turbidity curtains and use of best management practices for control of sedimentation, erosion, and turbidity impacts.
These same practices will limit the spread of invasive species.

Dear Honorable Members:
This is a very exciting time for the City of North Adams as we are on the cusp of signing Power Purchase and Site Lease Agreements regarding our Solar Project.
We have taken several months under the guidance of Robert Patterson our energy consultant and City Solicitor DeRosa to fine tune the agreements with Blue Wave Capital. As you may recall, the project includes arrays at the Land Fill, Airport, former waste Treatment Plant and Drury High School and has the potential when completed, to provide more than 4 megawatts of power. Mr. Patterson along with Ross Vivori and Mike Nuvallie have worked very hard with John DeVillars and Eric Graber-Lopez from Blue Wave to put together a package that has the potential to save the City $11,000,000 in electricity costs over the next 20 years.
I have invited Mr. DeVillars and Mr. Graber-Lopez to make a presentation at a Joint Public Hearing of the City Council, Planning Board, Zoning Board and Airport Commission at the Council meeting of February 14. Additionally, Mr. Vivori, Mr. Nuvallie and Attorney DeRosa will be on hand to help with any questions Council or board and commission members may have. This will also be a wonderful opportunity for the public to see this project as it continues to move forward. I am hoping to have an informational packet in advance with your papers for that meeting.

A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On October 3, 2006, the Department of Environmental Protection (MassDEP) issued a Tier IC Permit for Comprehensive Response Actions at the site. On December 14, 2011, LaValley Oil Company, Inc. filed an Application for a Tier 1 Permit Extension with MassDEP pursuant to 310 CMR 40.0703 and 40.0706. This Application will seek to extend the permit for this site from December 14, 2011 to December 14, 2014 based upon the following rationale:
to provide additional time to gain
access to an abutting property, and
to provide additional time to conduct assessment and remediation work at the disposal site.

SITE LOCATION: Tax Parcels Nos. J10-9-2 and J10-10-103 (known collectively as East Street Area 2-North) Pittsfield, MA 01201
In accordance with the requirements set forth in 310 C.M.R. 40.1403(7), as amended, and a Consent Decree executed by the General Electric Company ("GE"), the United States, the Commonwealth of Massachusetts, and other parties, and entered by the United States District Court for the District of Massachusetts on October 27, 2000 in United States et al. v. General Electric Company (Civil Action No. 99-30225-MAP et seq.), notice is hereby given that a Grant of Environmental Restriction and Easement on portions of the above disposal site, known as East Street Area 2-North, located at GE's facility in Pittsfield, Massachusetts (which portions are referred to herein collectively as the "Property"), has been recorded with the Berkshire Middle District Registry of Deeds on December 21, 2011. This Grant of Environmental Restriction and Easement (the "Grant") was executed by GE (the "Grantor") and accepted by the Massachusetts Department of Environmental Protection (the "Grantee").
The Grant will limit the following site activities and uses on the above Property, except as otherwise provided in the Grant:
A. residential activity or use;
B. day care and educational (for children under eighteen (18) years of age) activity or use;
C. community center (for children under eighteen (18) years of age) activity or use;
D. recreational activity or use;
E. agricultural activity or use;
F. extraction, consumption, or utilization of groundwater underlying the Property, including without limitation, extraction for potable, industrial, irrigation, or agricultural use;
G. excavation, digging, drilling, or other intrusive activity into or disturbance of the surface of the ground and/or the underlying soil (with various exceptions set forth in the Grant); and
H. any activity or use that would interfere with, or would be reasonably likely to interfere with, the implementation, operation, or maintenance of any aspect or component of the Response Actions already constructed or under construction, or of which Grantor has notice, including, without limitation, interference with any groundwater contaminant containment measures or barriers situated within the Groundwater Response Action Component Area (if any), or any groundwater monitoring wells or wells utilized for the recovery of groundwater or non-aqueous-phase liquid from the subsurface, or any activity that would exceed the bearing load of, or pierce, any barrier situated within the Building Demolition Barrier Area (all capitalized terms as defined in the Grant).
GE intends in the near future to convey the Property to the Pittsfield Economic Development Authority ("PEDA"), at which time PEDA will become the Grantor under the Grant.

WILLIAMSTOWN - The Planning Board will hold a public hearing on Tuesday February 14th, 2012 at 7 p.m. in the Municipal Building, 31 North Street, Williamstown, in accordance with Massachusetts General Law Chapter 40A §5, to receive public comment on the following proposals to amend the Williamstown Zoning Bylaw:
- ARTICLE 1: To see if the Town will vote to amend the Williamstown Zoning By-Laws, §70-7.1.D & §70-3.3(A)(1), by removing the existing provisions regarding conversion of a one family home to a two family home and replacing it with provisions to allow the conversion a one family home to a two family home and construction of a detached second dwelling unit on a single building lot.
- ARTICLE 2: To see if the Town will vote to amend the Williamstown Zoning By-Laws, §70-7.3 & §70-3.3(B) to allow weddings and similar celebration events to be held on farms as an accessory use as a matter of right, or by special permit if certain conditions are not met.
- ARTICLE 3: To see if the Town will vote to amend the Williamstown Zoning By-Laws, §70-7.3 & §70-3.3(B) to allow small concert events to be held on farms as an accessory use as a matter of right, or by special permit if certain conditions are not met.
- ARTICLE 4: To see if the Town will vote to amend the Williamstown Zoning By-Laws,§ 70-3.3A (4) Institutional Uses, so that the use "Dance or music studio" is amended to "Creative or physical arts studios and classes, including without limitation, use for dance, music, exercise, yoga or art classes."
