On February 21, 2003 the Pittsfield Conservation Commission issued Berkshire Community College a Certificate of Compliance. This in effect marks the end of a project by signifying that the Conservation Commission has inspected the site one last time and determined that all work was done in accordance with the Order of Conditions issued at the beginning of the project. The Pittsfield Conservation Commission was required to conduct a site visit before issuing the Certificate of Compliance. According to the Certificate of Compliance (issued in February of 2003), the site visit was conducted in August of 2002.

In addition, note that the letter from the Army Corps of Engineers was sent in October. The Conservation Commission was aware of this letter and of the issues discussed in it. Despite ongoing investigations by state and federal regulators, and despite the fact that Berkshire Community College was being required to implement a remediation program to restore wetlands and habitat, and without waiting for these issues to be resolved, the Pittsfield Conservation Commission issued the college a Certificate of Compliance.
